Terms of Service / Public Offer

Public Offer of Legal Entity LLP "EvoLane" (hereinafter – the Offer). This Offer is a Contract concluded between the Contractor and the service user — individual and/or legal entity (hereinafter — the Customer), which defines the conditions for purchasing and providing services using the Contractor's resources.

Terms and Definitions

  1. Tariff validity period — the period during which the Customer has the right to use services purchased from the Contractor under the selected tariff.

  2. Data processing — a set of actions with personal data, including collection, storage, use, modification, transfer and deletion.

  3. Confidential information — information provided by the Customer or obtained by the Contractor in the process of providing services, which shall not be disclosed without the Customer's consent.

  4. AI salesrep (also “Software”, “Software Product”, “Product”) — Software developed by the Contractor that performs automation and user interaction functions within the specified functionality.

  5. Tariff — a package of services offered by the Contractor and described on the website, which can be purchased by the Customer for an established price.

  6. Website — the website owned by the Contractor and located at the web address: https://evolane.org.

  7. Service — the Contractor's information system developed to provide specific information services on the Internet.

1. General Provisions

  1. The Contractor publishes this Offer with a proposal addressed to individuals and legal entities in accordance with Articles 395, 396 and 447 of the Civil Code of the Republic of Kazakhstan (hereinafter – CC RK).

  2. This Offer defines the essential conditions of interaction between the Contractor and the Customer (the person who accepted the Offer).

  3. This Offer is concluded between the Contractor and the Customer at the moment the Customer purchases a tariff for service provision.

  4. The Customer unconditionally accepts all conditions contained in the Offer in its entirety (in full and without exceptions).

  5. Acceptance is the receipt by the Contractor of a message about the intention to order services on the terms proposed by this Offer, expressed in making payment for the specified tariff on https://evolane.org.

  6. The Offer, changes, appendices to it, as well as additional information about the Contractor's services are published on https://evolane.org.

2. Status of the Contractor's Website

  1. The website is the property of the Contractor and is intended for organizing a remote method of selling services via the Internet.

  2. By accepting the Offer (i.e., paying for an order placed on the Contractor's website), the Customer will receive services on the terms and in the manner determined by the Contract for the provision of the Contractor's services posted at https://evolane.org/terms.

  3. The Contractor is not responsible for the content and reliability of information provided by the Customer when purchasing a tariff on the Contractor's website.

3. Customer Status

  1. The Customer is responsible for the reliability of information provided when purchasing a tariff, and its freedom from third-party claims. The Customer also confirms that they have all necessary powers to provide all information necessary for registration and creation of an AI salesrep.

  2. The Customer understands and realizes all functionality, capabilities and features of the Software, and takes responsibility for possible incorrect operation due to combination with other software.

  3. The Customer confirms their agreement by marking the box “I agree to the terms of the contract and offer” when purchasing a tariff and also agrees to the Privacy Policy at https://evolane.orgprivacy-policy.

  4. Information provided by the Customer is confidential. By providing personal data, registering on the website or filling out an application, the Customer gives consent to processing personal data for the purpose of fulfilling the user agreement.

  5. Using the website to view and select services, as well as to purchase a tariff, is free for the Customer.

4. Subject of the Offer

  1. The Contractor undertakes to provide services (access to the AI salesrep Software) in accordance with the conditions and prices established on the website.

  2. The Contractor's obligations are considered fulfilled at the moment of providing the Customer access to the Software tariff purchased by the Customer.

  3. Provision of services may be carried out personally by the Contractor or by third parties engaged by the Contractor.

  4. All rights to the AI salesrep belong to the Contractor unless otherwise agreed by the parties in writing.

5. Contract Conclusion Procedure

  1. When purchasing a tariff, the Customer must: (1) register on the service, (2) select the necessary tariff and complete payment.

  2. The Customer may submit an application through the order form, via a Contractor specialist using information and telecommunications means, or by email at alinurdzjeenbekov@gmail.com.

  3. To obtain a paper copy of the Offer Contract, the Customer sends an application by email or other means agreed with a Contractor specialist.

6. Tariff Information

  1. Information about tariffs is displayed through text and graphic elements and is the property of the Contractor.

  2. Each tariff is accompanied by textual information with conditions, price and description of the provided service.

  3. Materials are for reference purposes and may not fully convey the properties and characteristics of services. Questions should be addressed to a Contractor specialist before purchase.

7. Service Purchase Procedure

  1. The Customer has the right to purchase only one of the presented tariffs available on the Contractor's website. The Customer does not have the right to purchase more than 1 (one) tariff and have multiple tariffs at the same time.

  2. A tariff can be purchased on the website or through an invoice issued by the Contractor.

  3. After purchase, the Customer receives access within 30 (thirty) minutes. If functionality is not received, the Customer must contact the Contractor to resolve the issue.

  4. The service provision period under the tariff is 30 (thirty) calendar days from the payment date. After expiry, the tariff cost will be charged to the Customer's card or a new invoice will be issued to continue service provision.

8. Service Payment

  1. Payment methods and procedures are specified on the website in the "Pricing" section. Tariff payment by cash is not made.

  2. Cashless payment is made at the moment of tariff payment. After payment processing, functionality described in the purchased tariff becomes available.

  3. Party settlements when paying for an order are carried out in tenge of the Republic of Kazakhstan provided that the Customer is a resident of the Republic of Kazakhstan.

  4. For non-residents of the Republic of Kazakhstan, payment may be made in foreign currency at a cost equivalent to the Services cost established in tenge at the National Bank of the Republic of Kazakhstan exchange rate at the time of purchase.

  5. The tariff validity period is 30 (thirty) calendar days from the payment date. If funds are not charged on renewal, the Customer will lose access within 3 days after expiry; the Customer can resume at any time.

9. Subscription Refund

The Customer does not have the right to refuse services performed (provided) in a proper manner.

Refund of funds is possible only in the following cases:

  • If Services were not provided within the timeframes stated in this Offer;
  • If the Contractor did not provide access to the Software;
  • If significant defects in the AI salesrep's operation were identified, which the Contractor could not eliminate within 5 (five) working days from receiving notification from the Customer.

A significant defect is an error that prevents the AI salesrep from functioning in accordance with information stated on the website.

Services are considered properly provided when access is provided after receiving payment. The Customer should familiarize themselves with capabilities and functionality on the website. For questions, the Customer may contact technical support or email alinurdzjeenbekov@gmail.com.

10. Party Liability

  1. The Parties bear responsibility in accordance with RK legislation.

  2. The Contractor is not liable for damage caused to the Customer due to improper use of service results.

  3. The Contractor is not liable for the Customer's failure to achieve expected results if functionality corresponds to the description.

  4. The Contractor is not liable for errors or failures caused by incorrect use by the Customer; functionality limitations related to Customer equipment/software; direct or indirect damage due to force majeure (Internet failures, server malfunctions, etc.); and the Customer's violation of RK legislation.

  5. Interference with the assistant's program code, unauthorized modification or transfer to third parties leads to cancellation of the Contractor's obligations under this Contract.

  6. Parties are released from liability for non-performance or improper performance during force majeure circumstances.

11. Other Conditions

  1. Norms defined by the legislation of the Republic of Kazakhstan apply to relations between the Customer and the Contractor.

  2. The Contractor and Customer may execute a written bilateral service agreement that does not contradict this Offer.

  4. All disputes are resolved through negotiations; if impossible, the Parties may apply to judicial authorities of the Republic of Kazakhstan at the Contractor's location.

  5. The Contractor reserves the right to expand/reduce the service offering, regulate access to ordering services, and suspend or terminate sale of services at their discretion.
